1. Acceptance of Terms
By accessing or using the website at lumacasadesign.com (the "Website"), or by engaging the services of LumaCasa Design Studio ("LumaCasa", "we", "us" or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Website or our services.
LumaCasa Design Studio is a design practice registered in Lagos State, Nigeria, with its principal place of business at 14A Bourdillon Road, Ikoyi, Lagos.
2. Use of the Website
You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Use the Website in any way that violates applicable Nigerian or international law
- Transmit any unsolicited commercial communications (spam)
- Attempt to gain unauthorised access to any part of the Website or our systems
- Reproduce, duplicate, copy or resell any part of our Website content without written permission
- Submit false, misleading or fraudulent information via any contact form
3. Intellectual Property
All content on this Website — including but not limited to text, photographs, graphics, logos, design concepts and visual layouts — is the property of LumaCasa Design Studio or its licensors and is protected by Nigerian and international copyright law.
You may view and print pages from the Website for personal, non-commercial use only. Any other reproduction, distribution or use of our content requires prior written consent from LumaCasa.
All design work, concepts, drawings, mood boards, 3D renders and specifications produced by LumaCasa for a client project remain the intellectual property of LumaCasa until full payment has been received. Upon final settlement, ownership of the final designs (not working files) is transferred to the client as specified in the project agreement.
4. Design Services
The following terms apply to all design services provided by LumaCasa:
4.1 Engagement
All project engagements are formalised through a written Project Agreement signed by both parties. No work commences until the agreement is executed and the deposit payment received.
4.2 Payment Terms
LumaCasa's standard payment structure is as follows:
- 40% deposit payable upon signing the Project Agreement
- 40% payable at the design development / mid-project milestone
- 20% balance payable prior to project handover
All payments are due in Nigerian Naira (₦) unless otherwise agreed in writing. Late payment may incur interest charges as specified in the Project Agreement.
4.3 Revisions
Each project tier includes a defined number of design revisions as outlined in the Project Agreement. Additional revisions beyond the agreed scope will be charged at our current hourly rate.
4.4 Cancellation
In the event of client cancellation after work has commenced, the deposit is non-refundable and LumaCasa reserves the right to invoice for work completed to date. LumaCasa reserves the right to withdraw from a project if payment obligations are not met, with reasonable written notice.
5. Consultations
Initial design consultations offered as "free" are provided at no cost and are conducted without obligation. LumaCasa does not guarantee that a consultation will result in a formal project engagement. Any advice given during a free consultation is indicative only and does not constitute a formal design proposal.
6. Disclaimer of Warranties
The Website and its content are provided on an "as is" basis. LumaCasa makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness or suitability of any content on the Website. We do not warrant that the Website will be available uninterrupted or error-free.
7. Limitation of Liability
To the fullest extent permitted by Nigerian law, LumaCasa shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Website or our services, or from any errors or omissions in the content of the Website.
Our total liability to you in connection with any project shall not exceed the total fees paid by you for that specific project.
8. Third-Party Links
Our Website may contain links to third-party websites or services. These links are provided for your convenience only. LumaCasa has no control over and accepts no responsibility for the content or practices of any third-party sites. Linking does not imply endorsement.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the use of our Website or services shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
10. Changes to These Terms
LumaCasa reserves the right to amend these Terms at any time. Updated terms will be posted on this page with a revised date. Continued use of the Website after changes constitutes your acceptance of the new terms.
